There are also a number of educational links on this website:As proposed by the bill, the Commissioner of the Bureau of Labor Standards would have the authority to establish general wage and labor standards for in-state establishments. Currently, the Commissioner has this authority for both in-state and out-of-state employers in certain circumstances. The proposed law would give the Commissioner the ability to establish minimum wage levels that can vary by county in the State. The proposed law would prohibit an employer or agent from requiring a worker to sign an arbitration agreement prior to receiving a job, except in the instance where the worker is not represented by an attorney or union and signed a release. Current law requires the worker to sign an arbitration agreement prior to receiving a job, but provides that the worker can remove this requirement if the employer offers the worker some form of compensation (other than wages) other than the wage he or she is paid for performing work. Current law also prohibits employers from charging workers for benefits that are mandated by law, unless the benefits are offered to all workers in the workplace. Current law provides that certain workers who are injured on or after April 1, 1997, are entitled to an increase in workers’ compensation benefits. This increase would be triggered by the employer failing to provide the worker with a safe working environment or failing to maintain a safe working environment in violation of the law. The new law would modify this provision by requiring the Commissioner to set a formula that factors into the increase the annual percentage of growth in the average state wage from 1997 to 2008. The proposed law would require employers to furnish the employer’s contact information and that of the worker’s contact information for a worker who is unable to be reached by the employer. Currently, workers are not required to provide their contact information to employers. This bill is a committee substitute for House Bill 4113.
